  HEALTH & SAFETY OFFENCES

Prosecution are increasingly brought by or on behalf of specialised agencies or where non-government organisations participate at the investigative stage. These include DWP, Trading Standards Departments, HSE, RSPCA, PSPB, the BPI and Performing Rights Society.

Such proceedings often involve factual situations and statutory provisions that are infrequently encountered in ordinary criminal practice. Chambers has acquired considerable expertise of such proceedings.

Examples include prosecutions involving endangered species of wildlife under CITES, breaches of food safety, public hygiene and product labelling legislation.

Counsel have been instructed in cases of alleged criminal contravention of planning legislation (e.g. unauthorised development), violation of company law, safety standards at work, and in respect of the Copyright, Designs & Patents Act 1988.

Such cases often require consideration of subordinate legislation, European Union law, and/or provisional of International Conventions.

In addition, Chambers has represented individuals prosecuted by their professional or governing bodies for specific offences relating to their occupation.
